Uncorking the Uniform Trust Decanting Act: What Decanting States, Prohibition States, and Teetotalers Can Learn
The Uniform Trust Decanting Act was approved by the Uniform Law Commission in July 2015 and the final version will be published by October 1, 2015. Whether or not your state has a decanting statute, and whether or not your state would ever adopt the Uniform Act, the UTDA is instructive on issues to address when decanting or when dealing with a previously decanted trust. The UTDA also provides a convenient way to incorporate decanting provisions into your new trusts even if your state has not enacted a decanting statute. Also learn the issues addressed in the UTDA that are not generally addressed in other decanting statutes, and the issues that the UTDA leaves unresolved.
