Session II: “I Think I Might Have Made a Mistake — What Do I Do Now?” (CLE: Ethics)
What should an estate planning lawyer do upon first becoming aware that the lawyer may have made a mistake in the course of representation of a client? Who should be notified, and what should be disclosed? If you know you have made a mistake, do you have an ethical duty to confess even if no one knows about it and it may be directly against your own personal interests to do so? Are you entitled to remain silent and defend yourself? Are there any ethical conflicts between the lawyer’s duty to the client and protecting the lawyer from liability for malpractice?
The speakers will analyze malpractice issues from the perspective of defendants and malpractice insurers.
