Session I: The Dead Hand, the Black Robes, and the Modernists: A Review of How State Courts Have Grappled with, and Occasionally Fumbled, the Uniform Trust Code

The Uniform Trust Code (“UTC”) was approved by the Uniform Law Commissioners in 2000 and provides the states with a comprehensive model for codifying their trust law. Despite the occasional controversy, the UTC with state specific variations has been enacted to date in twenty-four jurisdictions. Several state courts have now interpreted or otherwise dealt with the UTC in reported decisions. Our speakers will review the most significant cases and analyze how state judges are handling, or mishandling, the UTC, the impact of the cases on UTC jurisdictions, and the broader impact of the cases on trust law generally.
