War and PEAC: Battling the Tech Industry Back to the Negotiating Table over Fiduciary Access to Digital Property
The trusts and estates bar and the Uniform Law Commission vied with Google, et al., in 27 state legislatures earlier this year, pitting the ULC’s Uniform Fiduciary Access to Digital Assets Act (UFADAA) against the tech industry’s alternative bill, Privacy Expectations Afterlife & Choices (PEAC), and ending in a stalemate. The panel will discuss why the technology industry (and the ACLU) opposed UFADAA, how the ULC has changed the uniform act in response to its battle experience, and what the next steps will be on both sides of the issue.
