I Think You Made A Mistake: Watch What I Will Do To You Now! (CLE: Ethics)
During the ACTEC 2011 Summer meeting in Atlanta, the speakers for the program entitled “I Think I Might Have Made A Mistake! What Do I Do Now?” discussed malpractice issues from the perspective of defendants and malpractice insurers. For this program, we will change perspectives and will look at malpractice issues through the eyes of the plaintiff in typical estate planning and estate and trust administration situations.
The speakers will address the challenges and considerations in being a plaintiff in such matters. Who can sue the lawyer for the alleged error or omission? What should a fiduciary do when the fiduciary believes that prior counsel has committed a mistake? What malpractice claims are common in the T&E world? When must the plaintiff act? How are damages calculated and can they be mitigated? Our panel includes Randy Johnston, Esquire, a real gun slinging plaintiff’s lawyer who makes his living suing lawyers, so watch out!
